By accessing this Website and/or placing an order buyer agree to comply the terms and conditions below. If buyer do not agree to follow these terms and conditions you cannot use or place order.

SELLER DRAW BUYER’S ATTENTION TO THESE TERMS AND CONDITIONS WHICH APPLY WHENEVER THEY BUY GOODS FROM US ONLINE. PRICE AND PAYMENT

These prices are exclusive of delivery costs, which will be added to the total amount due as set out in the delivery section of our website. PAYMENT METHOD

Payment for all product and service made by buyer must be paid when buyer placed order. Seller acceptable payment method are credit/debit card, cheque or cash however cash payment is only accept for pick and collect order that elect by buyer.

We accept payment with most major credit and debit cards. Payment must be made at the time of the order or otherwise in accordance with such credit terms as seller have expressly agreed with buyer. Where payment is made at the time of the order, we will not actually charge your credit or debit card until we despatch your order.

DURATION OF CONTRACT

Buyer may terminate their contract with seller for the product and service buy at any time up to the end of the 30 days from the date buyer place the order. Buyer need to give reasonable reason for cancelling their contract in writing. Although we value any comments or suggestions that may help us improve our service. All requests for return for refund must be made within 30 days of delivery, and refunds can only be made to the original payment method. To cancel your contract buyer must complete the returns form, contact seller or use the returns procedure on the web site. Seller recommends that buyer obtain a certificate of posting from the Post Office for any returned items, as buyer is responsible for the goods until they reach to seller.

Seller reserves the right to terminate or cancel the contract between buyer and seller if:

1. Insufficient stock to deliver the goods buyer has ordered;

2. Do not deliver to buyer’s area; or

3. One or more of the items buyer ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by seller. If seller does cancel contract they will notify to buyer by email or by telephone, and will recredit to buyer’s account any sum deducted by seller from your card as soon as possible but in any event within 28 days of your order. Seller will not be obliged to offer any additional compensation for disappointment suffered.

SHIPPING & DELIVERY SERVICES

The way for delivery of the products will be agreed between the seller and the buyer and shown on the order confirmation. Seller make every effort to ensure that order arrives to as soon as possible. The buyer must inspect the products on delivery and, in the case where products have been delivered by carrier, sign the required proof of delivery document or collection acceptance document.

A signature on that document will constitute conclusive evidence against the buyer of receipt of the quantity of products indicated on that document free from any apparent defect or damage. The buyer may not reject the products or any part of them solely on the grounds of short delivery of a payment. If the products are to be damaged or defective on delivery, a description of the damage or defect must be given in writing at the time of delivery and signed by or on behalf of the buyer.

Seller will not accept returned items that have been damaged through misuse, neglect, accident or intent however caused. If buyer do not inform us within 2 working days, then seller will have no liability for items said to be damaged/faulty or incorrect on delivery. If buyer placed order before 3pm, our aim to product delivered in 5 to 7 working days (excluding Sunday and Bank Holiday), and the standard delivery charge is £4.99 within UK. For the express delivery, buyer need to place their order before 1pm and our aim to product delivered in 1 to 2 working days (excluding Sunday and Bank Holiday). For the express service there is a charge of £7.75 within the UK. We do next day and Saturday delivery service upon buyer’s special request. The charges for next day and Saturday services is vary from other delivery charges.

If it is likely to take longer then we will let buyer know, although this is uncommon. All orders require a signature on receipt. Seller may despatch multiple parcels to complete order however charge will be once per order. Buyers can also arrange delivery to different address if this is more convenient for them. If order not received within 7 working days, goods are damaged in transit and any questions relates to delivery buyer may contact seller on deliveryinfo@pearlfashion.co.uk within 2 working days upon receipt of the order.

RETURN POLICY

Seller is committed to providing great customer service. If you have a problem with your order please contact us via email on customerservice@pearlfashion.co.uk stating your order number, relevant product number, fault or problem and your contact details. Seller will reply with instructions on how to return your item or whether may ask buyer to email us further proof such as photo of the product. All returns enquiry must be made within 24 hours of receiving the goods. Seller will accept returns of any product if the products received are faulty, damaged, or do not match the description of website or wrong order received. According to The Consumer Protection (Distance Selling) Regulation 2000, buyer can return the product within 30 days.

If buyer would like to return any of our products for any of above reason, buyer will be responsible for the return postage, and the original delivery charge is not refundable. Under no circumstances we will able to accept the return of earrings or hair products as under compliance with current Health & Hygiene regulations. Please fill up form of Returns also include the reason you are returning the products. Seller will then issue you with a returns confirmation email giving clear instructions on how to return any items to us. All Products which are returned by the Buyer to the Seller must be returned with their original, undamaged packaging and must be in an unused condition (except only in the case of products which have been discovered to be faulty upon use).

Please note that without following these instructions and considering the relevant information within returned package seller will be unable to process return or issue a refund. Returns must be sent back in the original packaging.

Before contacting us please take note of the time‐scales required to process a refund, all should be finalized within 28 days. Seller cannot accept responsibility for parcels lost in transit. Upon receipt of items returned as faulty, seller will arrange for an exchange (Subject to availability). The decision made by seller is final.

A waiver by seller of any default shall not constitute a waiver of any subsequent default. No waiver by seller of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with condition notice.

Seller and buyer will comply with its obligations under The Act (as amended or replaced from time to time), together with any applicable regulations issued under such legislation.

Seller and buyer will process all data which may be provided to it strictly in accordance with The Act and further shall not place the other party in breach of its obligations as Data Controller. Seller and buyer has in place appropriate technical and legislative measures against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, unlawful or unauthorised use or processing of Personal Data and that any persons it authorises to have access to Personal Data will respect and maintain the confidentiality and security of the Personal Data. Seller and buyer shall not transfer any identifiable Personal Data without any consent unless each party has taken all measures required by law to allow for such transfer. Seller and buyer authorisations that when processing

Personal Data on behalf of the individual third parties it shall:

i.  keep the Personal Data confidential and not disclose the Personal Data to any third party except as authorised by the Data Controller;

ii. Only process Personal Data for the purposes of this Agreement.

WRITTEN COMMUNICATIONS

Applicable laws require that some of the information or communications that seller send to buyer should be in writing. When using our website, buyer accept that communication with seller will be mainly electronic. Seller may contact buyer by email, written and oral communication. For contractual purposes, buyer agree to this electronic means of communication and acknowledge that all contracts, notices, information and other communications that seller provide to buyer electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

FORCE MAJEURE

a) Seller shall not be liable to the buyer or be deemed to be in breach of the agreement by reason of any delay in performing or any failure to perform any seller’s obligations in respect of goods and services, if the delay or failure was due to any cause beyond our company’s control. Following terms shall be regarded as causes beyond seller’s reasonable control:

 Act of god, Explosion, Flood, Fire or accident, Treat of war, Restrictions.

b) If seller unable to provide goods and services within a reasonable time frame due to circumstances outside our control, seller may terminate the contract with written notice.

ENTIRE AGREEMENT

These terms and conditions, together with our up‐to‐date website prices, delivery details, contact details and privacy policy, established the whole of our agreement relating to the supply of the goods and services to buyer by seller. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods and services offered for sale by seller. Save for fraud or fraudulent misrepresentation, seller shall have no liability for any such representation being untrue or misleading.

SEVER ABILITY

If any of these terms and Conditions or any provisions of a Contract are resolute by any competent authority to be invalid, unlawful or unenforceable to any point, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, seller accepts no liability for any direct or indirect loss or damage, predictable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Buyer should be aware that they use the Web Site and its content at their own risk.

TRANSFER OF RIGHTS AND OBLIGATIONS

The contract between seller and buyer is binding on you and us and on our respective successors and assigns. Buyer may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent. Seller may transfer, assign, charge, subcontract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

OUR RIGHT TO AMENDMENTS THIS TERMS AND CONDITIONS

Buyer will be subject to the policies and terms and conditions in potency at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we accept your order (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the products).
